Last updated: 10/8/2026
1. Introduction
Welcome to Bijective's website and software platform.
These Terms of Service ("Terms") govern access to and use of Bijective's website, software platform, documentation, customer portal, and related services.
By accessing or using any part of Bijective's services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use Bijective's services.
2. Scope of Services
Bijective develops software intended to support professional crypto trading operations. Its products are designed to assist engineering teams responsible for building, deploying, operating, and maintaining trading systems.
Bijective delivers software, updates, documentation, and technical support. The Client receives the source code and runs the platform in its own environment. Bijective does not host, operate, monitor, or manage the Client's systems.
Unless expressly agreed in writing, Bijective does not provide investment advice; financial advice; trading recommendations; portfolio management; brokerage services; asset custody; execution services; discretionary trading; or fund management.
3. Operational Confidence
Operational Confidence is Bijective's engineering philosophy. Bijective works to reduce operational risk through disciplined software engineering, architecture, testing, validation, and documentation.
Operational Confidence is a design aim. It is not a guarantee that software defects, operational incidents, service interruptions, compatibility issues, security events, or financial losses will never occur. Software systems involve technical risk.
4. Client Responsibilities
The Client is solely responsible for its own environment and decisions, including trading strategies; research methodologies; execution logic; capital allocation; risk limits and risk management; infrastructure and hosting; production deployment; environment configuration; security controls; exchange accounts and credentials; regulatory compliance; and internal operational governance.
Bijective does not review, approve, or validate Client trading strategies or investment decisions.
5. Third-Party Software
The platform may use third-party software, which remains subject to its own license terms and remains the property of its authors. Bijective is not affiliated with, endorsed by, or acting on behalf of any third-party project or its maintainers unless stated otherwise.
6. Updates and Support
Bijective provides software development, maintenance, updates, documentation, technical support, and guidance on using the platform, in accordance with the applicable commercial agreement. This includes new versions and changes needed when exchanges or venues change, within the Client's license and maintenance entitlement.
Support is provided in good faith and on a reasonable-efforts basis. Response targets, where they exist, are set by the applicable commercial agreement. Support relates to the software delivered by Bijective. It is not a guarantee that every issue can be resolved immediately or that incidents can be prevented, and it does not mean Bijective operates or is responsible for the Client's environment.
7. No Investment Representation
Nothing provided through the platform, documentation, website, or support is investment advice; financial advice; legal advice; tax advice; trading recommendations; or a recommendation to buy, sell, or hold any digital asset or financial instrument. The Client is solely responsible for evaluating the suitability of its own trading activities.
8. No Performance Guarantee
Bijective makes no representation or warranty regarding trading profitability; investment performance; execution outcomes; strategy effectiveness; market performance; or financial results achieved through use of the platform.
9. Platform Availability
The platform runs where the Client runs it, so its availability depends on the Client's environment. Bijective does not warrant that the platform will operate without interruption, defects, compatibility issues, configuration errors, or incidents.
10. Operational Risk
Operating trading infrastructure involves technical, operational, regulatory, market, and security risks. Incidents may arise from many factors, including Client-developed software; Client configuration; Client infrastructure; third-party software; exchange systems; external service providers; network failures; cloud infrastructure; cybersecurity events; human error; and software defects. The Client acknowledges these risks when operating production trading systems.
11. Intellectual Property
Unless otherwise stated, all proprietary software, documentation, trademarks, branding, and other intellectual property developed by Bijective remain the property of Bijective. Use of the platform does not transfer ownership except as expressly provided in the applicable license agreement.
12. Third-Party Services
The platform may interact with third-party exchanges, infrastructure providers, cloud services, APIs, or software components. Bijective does not control their availability, security, functionality, or policies. The Client is responsible for evaluating and managing the risks of third-party services.
13. Digital Assets
Bijective does not issue, operate, endorse, or promote any cryptocurrency, digital token, stablecoin, NFT collection, or similar digital asset unless explicitly announced through Bijective's official communication channels. Unauthorized use of Bijective's name, trademarks, or branding in connection with digital assets is not an official product or endorsement.
14. Scope of Responsibility
Bijective is responsible for developing, maintaining, updating, documenting, and supporting its software. Providing support is not an acceptance of responsibility for Client trading outcomes, investment decisions, operational losses, regulatory consequences, or other business risks of operating trading infrastructure. Any limitation of liability applicable to commercial Clients is governed by the applicable commercial agreement.
15. As-Is and Limitation of Liability
To the fullest extent permitted by applicable law, the website, documentation, platform, source code, and all related software and services are provided on an "as is" and "as available" basis, without any warranty of any kind, whether express, implied, or statutory.
Bijective disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by applicable law.
To the fullest extent permitted by applicable law, Bijective, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with the use of, or inability to use, the platform, even if advised of the possibility of such damages.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.
16. Changes
Bijective may modify these Terms from time to time. Updated versions will be published on Bijective's website with an updated revision date. Continued use of the services after publication constitutes acceptance of the revised Terms.
17. Governing Law
This section will be specified in the applicable commercial agreement or according to the jurisdiction designated by Bijective.
18. Contact
Questions regarding these Terms may be directed through Bijective's official contact channels.
